Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and SurfaceMeasure (“SurfaceMeasure,” “we,” “us,” or “our”). They apply to the SurfaceMeasure website, application, and related services (together, the “Service”). If you do not agree to these Terms, do not use the Service.

SurfaceMeasure is a web tool that lets contractors and other users measure flat outdoor surfaces — such as driveways, pool decks, patios, and paver areas — by tracing them on satellite and aerial imagery, and then export the resulting square footage into quotes and reports.

Measurements produced by the Service are estimates derived from third-party imagery. They are intended to help you quote and plan jobs faster — not to replace a physical survey, on-site verification, or professional judgment. See Section 6.

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide and for keeping your login credentials secure. You are responsible for all activity that occurs under your account.

Notify us promptly at Caden@cjessopcompany.com if you believe your account has been accessed without authorization.

The Service offers a free tier that includes a limited number of measurements, and a paid “Pro” subscription billed monthly or annually. Current pricing is shown on our pricing page.

Paid subscriptions are processed by our payment provider, Stripe. By subscribing, you authorize us (through Stripe) to charge your payment method on a recurring basis until you cancel. Subscriptions renew automatically at the end of each billing period at the then-current rate unless you cancel before the renewal date.

You can cancel at any time from your account's billing portal. When you cancel, your Pro access continues until the end of the current billing period and then does not renew. We may change subscription pricing or features; if we do, we will give reasonable notice and changes will apply to the next billing period.

Except where required by law, payments are non-refundable and there are no refunds or credits for partial billing periods. If you believe you were charged in error, contact us at Caden@cjessopcompany.com and we will review it in good faith.

Satellite and aerial imagery varies in resolution, age, and alignment. Measurements depend on the imagery available for a property and on how you trace each surface. You are solely responsible for verifying measurements before relying on them to price a job, order materials, or enter into a contract with your own customers.

SurfaceMeasure does not guarantee that any measurement is accurate or fit for a particular purpose, and is not responsible for losses arising from quotes, material orders, or jobs based on Service measurements. For critical work, confirm dimensions on site.

You agree not to:

• Use the Service in violation of any law or third-party right; • attempt to access accounts or data that are not yours; • copy, scrape, resell, or redistribute the Service or its imagery except as expressly permitted; • interfere with or disrupt the Service or its infrastructure; or • use the Service to build a competing product.

The Service, including its software, design, and content (excluding third-party imagery and your own data), is owned by SurfaceMeasure and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for your business. Measurements, notes, and quotes you create remain yours.

The Service relies on third-party providers, including Google Maps Platform (imagery and maps), Stripe (payments), and Supabase (authentication and data storage). Your use of features powered by these providers may be subject to their terms. We are not responsible for third-party services or their availability.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, SurfaceMeasure and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $100.

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we reasonably believe your use creates risk or legal exposure. Sections that by their nature should survive termination (including Sections 6, 8, 10, 11, and 14) will survive.

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of [STATE], United States, without regard to its conflict of laws rules. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in [COUNTY/STATE], except where prohibited by law.
